540.9 Reporting Suspected Child Abuse/Neglect
| P-540.9 | College instructors, administrators, staff, and other employees with responsibility for direct interaction with a child, are considered to be mandatory reporters of suspected child abuse/neglect. This means that they have a legal and ethical duty to report child abuse/neglect to state authorities. (A child is defined as any person under 18 years of age.) |
| Pr-540.9.1 | If an instructor, administrator, or other employee who is a mandatory reporter has reasonable cause to suspect that a child has been or may be subjected to abuse or neglect or observes a child being subjected to conditions or circumstances which would reasonably result in abuse or neglect, that person must immediately notify the Child Abuse & Neglect Hotline at 1-800-392-3738. No internal investigation shall be initiated until such a report has been made. |
| Pr-540.9.2 | Following a report of abuse, employees have a duty to cooperate with investigators from the Division of Family Services and law enforcement authorities. |

Abuse is defined as "...Any physical injury, sexual abuse, or emotional abuse inflicted on a child other than by accidental means by those responsible for the child’s care, custody, or control, except that discipline including spanking, administered in a reasonable manner, shall not be construed to be abuse." Neglect is defined as,"...Failure to provide by those responsible for the care, custody, and control of the child's care, custody, and control of the child, the proper or necessary support, education as required by law, nutrition or medial, surgical, or any other care necessary for the child's well-being." Those responsible for the care, custody, and control of the child are defined as: "...Those included but not limited to the parents or guardian of a child, other members of the child's household, or those exercising supervision over a child for any part of a 24 hour day. It shall also include any adult, who, based on the relationship to the parents of the child, members of the child's household or the family, has access to the child."
